Kim Zolciak’s Son KJ Biermann Indicted on 7 Charges in Sexual Assault Case
Kroy "KJ" Biermann Jr.'s lawyer says the legal process has only begun.
After Kim Zolciak and Kroy Biermann's son was indicted on seven counts related to sexual assault on Sept. 3, including sexual battery against a child under 16 and false imprisonment, his attorney Jason Sheffield has responded by stating that the case moving forward will allow his client's innocence to be proven.
"I respect the difficult responsibilities carried by prosecutors and victim advocates," Sheffield wrote in a Sept. 3 statement to E! News. "Cases involving children require patience, care and a commitment from all of us to understanding the full picture as the process continues."
KJ, 15, is accused of committing the alleged acts on April 23, 2026, in the changing area of a Lifetime gym, according to a criminal warrant. His attorney noted, "KJ was 14 years old when these events allegedly occurred" and detailed the importance of putting forth their account of events, which the judicial process allows defendants to do further down the line.
"An arrest and an indictment cannot tell us the whole truth of a case because, at those stages, the magistrate judge and the grand jury have heard only one side," he said. "The accused has no right to participate, present evidence, cross-examine witnesses, or have a voice in the proceeding."
As such, Sheffield explained KJ’s side hasn’t yet been shared, clarifying that the assessment was not "a criticism" of the process, but rather "simply where we are."
KJ is currently detained following his Aug. 17 arrest in Alpharetta, Ga., and his lawyer looks forward to presenting evidence he says will clear the charges against his client.
"Without DNA evidence, the case remains one of 'she said, he said.'" Sheffield wrote. "The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations."

Thus far, Sheffield has been able to petition for the minor's release on bond, per court documents obtained by TMZ, which describe KJ as "a high school student in good standing" who is not a flight risk.
Before the indictment, Kim also emphasized her belief that evidence will lead to KJ's exoneration.
"Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation," the Bravo star told E! News Aug 21. "We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations."
In addition, the Real Housewives of Atlanta alum stated that no DNA evidence implicating KJ was found during an investigation of the alleged event and that he passed a voluntary polygraph exam.
