The dispute between Dynamite Comics/Dynamic Forces and New Diamond is heating up, with a hearing date set to consider Dynamite’s claim that New Diamond owes them more than half a million dollars.
On May 27th Dynamite filed a complaint alleging that Diamond owed them $509,114.21 for comics they had shipped over a three week period.

The filing included a long lists of products Diamond had ordered from Dynamite. Dynamite also asked for attorneys’ fees, late fees and interest regarding the late payment and efforts to collect.
New Diamond fired back on June 10th, filing a counter claim saying that this was not the final amount. “In particular, the Debtors believe the asserted amount is overstated and fails to account for certain of the Debtors’ setoff rights.” New Diamond also rejected the payment of administrative fees under legal technicalities, and further stated that “Dynamite has not demonstrated that it will suffer any hardship should it not receive immediate payment….These assertions do not establish a particularized harm or prejudice sufficient to warrant immediate payment of Dynamite’s claim.”
In other words: it’s on.
Or maybe not. A settlement could be reached before the July 16th hearing date. However, neither of these two parties seem like the type to give in.
It’s significant to note that the unpaid invoices are from the period before New Diamond/Sparkle Pop took ownership of Diamond Comic Distributors on May 15th. Old Diamond was paying most invoices in the period after the bankruptcy but before the ownership change. As we’ve heard many times, now New Diamond isn’t paying anyone.
Where Dynamite will end up remains the last piece of the Diamond bankruptcy puzzle, and it’s indeed a very puzzling one. The dispute hinted at in these filing suggest that there is a rather large behind the scenes battle going on.
