Dak Prescott and Sarah Jane Ramos come to custody agreement

Dak Prescott and his former fiancée, Sarah Jane Ramos, have come to an agreement ahead of their custody hearing.

The former couple, who called off their wedding last month, share two children: daughters Margaret Jane Rose, 2, and Aurora Rayne, 10 months.

“This agreement is a positive step forward and reflects the commitment Dak has to raising their daughters in a healthy, supportive environment," Prescott's lawyer, Levi McCathern, said in a statement to PEOPLE. "We’re pleased this was resolved amicably and outside of the courtroom. At the end of the day, the focus remains where it should be — on the well-being of Dak’s two daughters — and he is fully committed to ensuring that.”

While the former couple have settled "the temporary visitation and financial terms" the agreement at this time is not finalized according to Ramos' attorney,  Raymond Rafool.

"This is temporary relief and not final.  The case proceeds forward but this agreement is a step in the right direction," says Rafool. "Sarah Jane always focused and focuses on the best interests and welfare of her children.  Sarah Jane and Dak worked together as parents which Sarah Jane believes is of the utmost importance for lasting benefits for the girls. Sarah Jane loves the girls and makes sure their best interests and lives always come first."

The couple had been dating for about three years before they decided to call off their wedding last month, which would have taken place overseas in Lake Como, Italy. In an email sent to wedding guests, obtained by TMZ, the couple shared about their "difficult decision" to cancel their wedding.

"It is with heavy hearts that we privately inform our attendees that we have made the very difficult decision to cancel our wedding. We deeply apologize for any inconvenience this may cause you and we welcome your prayers."
