Teacher, 35, charged with incest after allegedly having sex with her two adopted teens

A Washington state teacher who built a public profile advocating for foster children has been arrested on incest charges after authorities accused her of having sexual contact with two teenage boys that she adopted.

Amber Swain, 35, of Newport, was booked Tuesday on suspicion of first- and second-degree incest following an investigation by the Pend Oreille County Sheriff’s Office, according to local reports.

The allegations have rocked the small rural community where Swain worked as a teacher and director at Pend Oreille River School, the Newport School District’s alternative high school.

Authorities say the investigation began May 18 after the Washington Department of Children, Youth and Families contacted the sheriff’s office regarding possible sexual abuse involving two teenage males.

Investigators conducted forensic interviews with the alleged victims before detectives interviewed Swain on Tuesday. Deputies later determined there was probable cause to arrest her, according to reports citing the sheriff’s office.

Swain appeared in Pend Oreille County District Court the following day.

During the hearing, Prosecuting Attorney Dolly Hunt sought $50,000 bail and told the court there was evidence Swain had attempted to contact one of the alleged victims from jail, according to courtroom reporting by The Miner.

Judge Robin McCroskey set bail at $20,000.

Swain was released on Thursday under strict conditions that prohibit contact with anyone under 18, require her to remain in Washington state and mandate regular contact with legal counsel.

In their interviews with law enforcement, one of the boys admitted to having a sexual relationship with Swain before he turned 18 years of age, according to KREM-TV.

The teen told investigators that the two had sex “plenty of times” — even as recent as two days before the interview with law enforcement took place, KREM-TV reported.

Swain initially denied having sex with the teen when she was interviewed by investigators, the TV station reported. But she later told law enforcement that she did, indeed, have sex with one of the boys in February, which would have been after he turned 18.

Though Swain is later said to have told investigators: “I could have my timeline messed up.”

The other teen victim told investigators that he touched Swain multiple times while they were in bed together in May. He told law enforcement that the incident lasted a couple of minutes before Swain put a stop to it.

Prosecutors requested that Swain be barred from contacting the teens after she is alleged to have reached out to them while under arrest, KREM-TV reported.

The Newport School District moved quickly after the arrest, placing Swain on administrative leave and barring her from contact with students and staff while the case proceeds.

The criminal case is now headed to Pend Oreille County Superior Court, where Swain is scheduled to be arraigned on Monday.

Under Washington law, first-degree incest is a class B felony punishable by up to 10 years in prison and a $20,000 fine. Second-degree incest is a class C felony.

The Post has sought comment from Swain.
