A New Jersey man nearly lost his lunch when he stunningly found the dentures of a delivery driver inside his Jersey Mike’s cheesesteak — who tried to pin the stomach-turning mishap on her father, a new lawsuit revealed.

When Bayville resident Fernando Rodriguez ordered his sub-par delivery from the now private equity- owned Jersey Mike’s in April 2025, everything seemed fine — until he realized his teeth weren’t the only ones taking a bite out of his lunch.

Grubhub delivery driver Theresa Gildea left her dentures “to become embedded” within the cheesesteak, court papers claim.

While the cheesesteak “appeared packaged and sealed with scotch tape” when delivered, Rodriguez quickly “discovered foreign objects, specifically dentures, embedded within the sandwich,” according to the filing.

But it wasn’t just his lunch that was apparently ruined.

Rodriguez “experienced extreme shock, disgust, emotional distress, nausea, loss of appetite, and physical revulsion” at the stomach-turning discovery, court papers, filed last month in Middlesex County court, said.

“Finding a foreign object that came from another person’s mouth, in direct contact with a sandwich, is not only shocking and offensive, but raises serious concerns about contamination and food safety,” said Rodriguez’s attorney, Ian Goldman.

Cops later grilled the manager of the Jersey Mike’s in Lacey Township, who confirmed Rodriguez showed up at the shop with the cheesesteak and dentures demanding answers — and noted the bag did appear to be tampered with, according to a police report.

An officer then rang Gildea, who initially blamed her father and claimed he was eating at the Jersey Mike’s “and it was his dentures inside of Fernando’s sandwich,” the police report added.

But the cop wasn’t biting, and pressed the delivery driver over her “completely outlandish statements,” the report said.

Eventually Gildea confessed and explained that she was simultaneously eating her own lunch and checking to make sure Rodriguez’s order was correct due to “multiple complaints” over wrong orders, according to the report.

Somehow she “accidentally placed her dentures in Fernando’s sandwich,” she allegedly told the cop, who informed Gildea that her pearly whites were waiting for her at the Jersey Mike’s, according to the police report. 

The suit accuses Gildea of “tampering” with the cheesesteak, Grubhub for negligent training and hiring, and Jersey Mike’s for failing to “properly package, seal and secure food.”

Grubhub was “troubled by this report, as it doesn’t reflect the high standard of service our customers expect,” a spokesperson told The Post.

“We can confirm the individual in question is no longer contracted to deliver with Grubhub.”

Gildea could not be reached and Jersey Mike’s did not immediately respond to The Post’s request for comment.
