Kim Zolciak’s son KJ Biermann’s sodomy and sexual battery case escalates as prosecutors seek interviews with minors

Prosecutors have filed an emergency motion in Kim Zolciak’s son Kroy “KJ” Biermann Jr.’s sodomy and sexual battery case, Page Six can confirm.

In new court documents filed Thursday, prosecutors requested forensic interviews of “minor children” be ordered by the court.

A forensic interviews, notably, is “a neutral, developmentally and culturally appropriate conversation with a child intended to elicit detailed information about a possible event(s) that the child may have experienced or witnessed,” per the Georgia Center for Child Advocacy.

TMZ was the first to report the news, and additional details are not yet known at this time.

Zolciak’s rep and Biermann’s lawyer did not immediately respond to Page Six’s requests for comment.

The 15-year-old has been behind bars at Atlanta’s Metro Regional Youth Detention Center since his August arrest.

Earlier this month, he was indicted on charges of aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of aggravated sexual battery against a child under 16 over an alleged incident in Alpharetta, Georgia, in April.

Zolciak and Kroy Biermann’s teen was granted bond last week, but his release date has yet to be announced.

Once out, KJ will be subject to electric monitoring and be barred from having any direct or indirect contact with the alleged victim, her family or associates.

Additionally, he cannot be in contact with anyone aged 16 or under, he must stay at his mom’s home and attend school virtually, and, he must abstain from social media and avoid cellphone use of any kind.

Zolciak, notably, confiscated the teen’s phone more than one year before being detained, Page Six reported Thursday, over an unknown “discovery” on the device.

During the contentious Sept. 11 hearing, at which KJ’s bond was set at $200,000, Deputy District Attorney Caitlin McGillicuddy revealed the high school student’s legal troubles date back much further than was publicly known.

The prosecutor alleged investigators previously found multiple videos on KJ’s phone depicting him having sex with a female family member under the age of 12 while using “predatory, derogatory” language toward the alleged victim on “multiple occasions.”

This was initially reported in 2023 — and KJ has, as a result, been under court supervision since October 2025.

KJ’s lawyer, Jason Sheffield, subsequently insisted to Page Six that the “characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case.”

“The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense,” he continued. “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

Sheffield added that his client expects to plead not guilty to all charges at his arraignment on Oct. 14.
