Emilie Kiser's Husband Was Watching Newborn When Son Trigg Drowned
Brady Kiser is potentially facing legal trouble in relation to son Trigg Kiser's death.
Two months after the 3-year-old son of Brady and influencer Emilie Kiser died after an accidental drowning in a pool at the family's home outside of Phoenix, the Chandler Police Department announced that its investigation into Trigg's has been completed.
"Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser," the statement posted to X July 15 read. "The case has now been submitted to the Maricopa Country Attorney's Office for review."
Upon review of the case file, prosecution could decide to pursue charges against Brady or to drop them entirely, People reported. A Class 4 felony is an act committed with criminal negligence and could result in a sentence of up to three years in prison, per Arizona law.
The update comes one month after police search warrants obtained by USA Today affiliate The Arizona Republic shed some light on the events that authorities say led to Trigg's tragic death.
According to the applications, Brady told police he was home with his and Emilie's sons Trigg and 2-month-old son Theodore while she was out with friends May 12. While their oldest son was out playing by the pool, which was "not uncommon" for him to do, Brady reportedly told police that there was normally a protective cover over the pool.

However, Brady was "soon distracted" by Theodore and lost track of Trigg for three to five minutes, per the search warrant applications obtained by the outlet. After finding him floating in their pool, Brady told police that he jumped into the pool, pulled Trigg out and then called 911.
Police said that officers performed CPR on Trigg until firefighters arrived and took over medical care on the scene, USA Today reported, citing the applications.
The 3-year-old died in the hospital May 18, six days after the incident.
According to USA Today, the search warrant applications—which were filed on May 13—sought to acquire the footage from two outdoor cameras police saw in the backyard that may have captured what happened.

In the weeks following her son’s death, Emilie has filed a lawsuit—obtained by E! News—against multiple Maricopa County public offices seeking to keep records about Trigg’s passing private.
While neither Emilie nor Brady has personally spoken out or posted to social media since their son's death, the influencer's lawyer shed light on how she's been dealing with the tragedy.
"Emilie is going through a parent’s worst nightmare right now," her May lawsuit stated. "She lost her young son."
The attorney also noted that "Emilie is trying her best to be there for her surviving son, 2-month-old Theodore. But every day is a battle."
