Denise Richards’ lawyer accuses Aaron Phypers of harassment and stealing as divorce battle heats up

Denise Richards’ lawyer is accusing her estranged husband, Aaron Phypers, of continued harassment and stealing from the “RHOBH” alum.

“Mr. Phypers has continued to harass Ms. Richards since being served with the Temporary Restraining Order by, among other things, disseminating private information from Ms. Richards’ cell phone and laptop, which he stole,” her divorce attorney, Brett Berman, said in a statement to People magazine Monday.

“These actions continue to disturb Ms. Richards’ peace,” the lawyer added.

Richards’ attorney claims that they have “warned” Phypers “in writing” — telling him not to “disseminate any information from Ms. Richards’ stolen cell phone and laptop.”

“But, he continues to do so,” the statement continued. “Ms. Richards will not be responding to Mr. Phypers’ false allegations in a public forum, and will be addressing Mr. Phypers’ abuse in Court.”

Phypers, 52, swiftly denied the claims, telling the outlet that the model, 54, seems to be experiencing “another one of her now-infamous ‘upside-down jacket’ moments” (referring to when she famously wore her fur coat upside-down in a Season 13 episode of “The Real Housewives of Beverly Hills.”)

“Her well-paid handlers appear determined to spin it upright, no matter the cost or collateral damage,” he claimed. “We genuinely hope she receives the help and support she clearly needs. As Denise herself once famously slurred in a less-than-sober moment — words that now echo with irony — ‘Stop it. I know what you are doing.'”

Phypers concluded by claiming that “nothing was stolen.”

“And nothing is missing — except, perhaps, Ms. Richards’ moral compass,” he snapped.

The actor recently accused the “Wild Things” star of having an “ongoing affair” and an addiction to Vicodin.

“For nearly a decade, she has struggled with an addiction to Vicodin (which she jokingly calls ‘Vitamin D’ or ‘white chestnuts’), mixed with Adderall and tequila,” he claimed in an explosive letter obtained by Page Six Sunday.

He continued, “Some of you know this has been an issue for over 20 years. She’s no longer eating real meals, and I’ve witnessed her pass out from substances — putting herself and others in danger, including while driving with our daughter.”

Phypers — who shares daughter Eloise, 14, with Richards — wrote that the actress also “begged” him not to leave her after discovering she was allegedly having an affair.

“She begged me not to leave, saying it was nothing and that she only loved me,” Phypers alleged in the letter. “Then, she denied it all — even the explicit messages I found. Despite her promise to stop, more lies and shocking evidence emerged.”

Phypers went on to accuse Richards of physically abusing him on July 4 — which he listed as the date of their separation in his divorce filing. He filed for divorce on July 7 after six years of marriage.

He claimed Richards accused him of using her credit card and subsequently couldn’t find his phone anywhere.

“After searching for over 20 hours and being physically attacked when I asked for it back, I eventually found it smashed inside a trash bag, hidden beneath rotting garbage and litter,” he wrote. “When I asked why, she denied it completely. That same night, she texted me saying she was filing for divorce.”

Richards was granted a restraining order against Phypers shortly after he filed for divorce, claiming that he was abusive and left her with a black-and-blue eye.

“Throughout our relationship, Aaron would frequently violently choke me, violently squeeze my head with both hands, tightly squeeze my arms, violently slap me in my face and head, aggressively slam my head into the bathroom towel rack,” Richards alleged in court docs.

She also claimed in the filing that Phypers threatened to kill her if she ever reported him to the police.

Phypers denied her allegations, calling her claims “harmful and baseless.” A source close to Phypers told us that her bruised eye was due to Richards allegedly falling up the stairs when she was drunk in 2022.

Reps for Richards did not immediately respond to Page Six’s request for comment.
